Bard Settles 2nd Bellwether Transvaginal Mesh Lawsuit

C.R. Bard recently settled the second federal Avaulta transvaginal mesh bellwether case just before trial which was scheduled to start last week. The settlement terms between Bard and the plaintiff, a North Carolina woman named Wanda Queen, are undisclosed. The announcement was made by U.S. District Court Judge Joseph R. Goodwin, who presides over all six surgical mesh consolidated federal multi-district litigation (MDL) dockets. Besides the Bard consolidated cases, Judge Goodwin presides over litigation involving American Medical Systems, Inc., Boston Scientific Corp., Coloplast Corp., Cook Medical, Inc., and Ethicon, Inc.

This settlement occurred one week after Bard lost its first Avaulta transvaginal mesh trial before Judge Goodwin, when a jury awarded Donna Cisson $2 million in compensatory and punitive damages. The jury ruled that Bard had failed to warn of Donna Cisson of the defect in its transvaginal mesh device, which caused plaintiff Cisson to undergo several surgeries to remove it, as well as suffer painful side effects, including bleeding, constant intractable pain and bladder spasms.

A third bellwether case is scheduled for trial before Judge Goodwin on October 8, and a fourth trial will take place on November 4. There are over 20,000 transvaginal mesh lawsuits pending in total against the six manufacturers with cases consolidated before Judge Goodwin. The results of these four bellwether trials will help the court encourage the plaintiffs and the defendants to settle the other pending cases
